A three-judge panel of the 2nd U.S. Circuit Court of Appeals in Manhattan said a lower court judge acted properly in imposing the ban and ordering Shkreli to repay $64.6 million because of his antitrust violations.

Vyera Pharmaceuticals, which previously settled price-fixing charges that resulted in founder Martin Shkreli being banned from the pharmaceutical industry, filed for bankruptcy late Tuesday to sell its assets.

Martin Shkreli on Friday urged a U.S. judge not to hold him in civil contempt for failing to provide federal and state regulators with information to determine whether he is violating a lifetime ban from working in the pharmaceutical industry.

In a filing in Manhattan federal court, the Federal Trade Commission said Shkreli has not complied with its requests for information relating to Druglike Inc., a company it said he formed last July, and noted his apparent failure to pay any of a $64.6 million penalty that accompanied the ban.
