A federal appeals court, in a decision unsealed Wednesday, upheld the dismissal of a whistleblower lawsuit against Johnson & Johnson as a sanction for the plaintiffs’ misuse of confidential records they obtained through related litigation.

The U.S. Supreme Court on Thursday gave a boost to whistleblowers in their bid to revive lawsuits accusing pharmacy operators of knowingly overbilling government health insurance programs for prescription drugs at taxpayers’ expense.

The U.S. Supreme Court on Tuesday considered a bid by three whistleblowers to revive lawsuits accusing pharmacy operators of pocketing millions of taxpayer dollars by knowingly overbilling government health insurance programs for prescription drugs.

The lawsuit accused Biogen of directing millions of dollars in kickbacks to doctors to prescribe its MS drugs Avonex, Tysabri and Tecfidera from 2009 to 2014, with kickbacks delivered in the form of “sham” consulting deals and speaker programs as well as lavish dinners and entertainment.
