A Florida judge on Tuesday dismissed Eli Lilly’s case against a compounding pharmacy, finding that the drugmaker cannot use state law in its campaign against reformulated versions of the company’s top-selling weight-loss and diabetes medication tirzepatide.

Yesterday Novo Nordisk said it sued one compounding pharmacy and refiled a lawsuit against another after finding their products claiming to contain the active ingredient for its in-demand weight-loss drug Wegovy were impure, some by as much as 33%.

The FDA has warned that drug compounders are selling products that falsely claim to contain semaglutide, the same active ingredient as Novo Nordisk’s blockbuster diabetes and obesity drugs Ozempic and Wegovy their oral sibling Rybelsus.

A former employee of a Massachusetts compounding pharmacy whose mold-tainted drugs sparked a deadly nationwide fungal meningitis outbreak in 2012 was sentenced on Tuesday to five months in prison for deceiving regulators about its operations before the tragedy.
