A German court invalidated a patent that was the basis of a patent violation lawsuit brought by CureVac against its domestic rival BioNTech, in a blow to CureVac’s claims for a share in billions of euros in COVID-19 vaccine revenues.

The Duesseldorf regional court said it needed further clarification and suspended the case, brought by BioNTech competitor CureVac, pending a decision by the federal patent court on a lawsuit filed by BioNTech.

The company said it filed a counterclaim alleging that Pfizer and its German partner BioNTech infringed on nine of its patents, broader than its original claim of three patents.

COVID-19 vaccine maker BioNTech said on Tuesday that it and partner Pfizer have filed a complaint with the U.S. District Court in Massachusetts, seeking a judgment that they did not infringe U.S. patents held by rival CureVac.

CureVac has filed a patent lawsuit in Germany against BioNTech over its use of mRNA technology, marking one of the first known cases of a company going to court amid the fierce competition to develop a vaccine against the coronavirus.
